    My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
    Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
    Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.

    All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

    Quite honestly I think the best value from an MBA is derived from the timing, i.e. where one is in his / her career. I had a B Com (Accounting) from University of Sydney, an American CPA, combined with 10 years of work experience whilst enrolling for the MBA. I knew ahead, the curriculum wasn't going to bring added technical knowledge, however, it did bring some new ways of approaching the business community. Having the opportunity to sit in a class room and share / hear experiences from some of the successful executives does broaden the thought process. The program also helps build / expand the network. Again, I didn't feel I learnt something groundbreaking on the technical aspects of accounting / financial analysis, or the everyday business etc, but I wouldn't say it was completely useless. Plus for some reason, the "tag" does help.

    BTW, I'm not sure the background of those who provided you feedback. My sentiments are shared at least by 3 good friends. One is a Wharton Alum and the other two, from University of Toronto. All of whom had at least 14 years of work experience, and were Canadian Chartered Accountants at the time of enrollment. The feedback could vary depending on the backgrounds.

    Zoom, thanks for the initiative. Just wanted to make sure if there are any legality issues behind core accessing the IV funds for administrative costs. Because once we donate it to IV funds(unless there is a provision for them to access that money as reimbursement administrative cost) it may not serve the intended purpose.

    I completely agree with Logiclife and the goals IV has setforth to solve our problems. There is only so much one can achieve with limited resources under which IV operates.
    We need to have a set of priorities and work on that one step at time. Though I have not been to DC, I can understand what IV is going through to get us some relief. The least I can do is contribute for our cause and thats what I am doing right now.
    I wish people had some common sense and better understanding of the bigger picture(& issues) before they get involved in finger pointing and asking for more.
    Everyone, please be patient and support IV whole heartedly and financially so that we can atleast attempt to fix the broken immigration system. Though I am VERY optimistic that we will achieve our goals in the near future, but I would not regret even once, if we failed. It is better to try and fail than not give it a shot at all.

    Anyways, good thread. This site should help people fix the broken system rather than abuse each other or track all day. I hope due to the discussion, people can get some ideas and take action against such employers. IV will be willing to help as needed.

    Wish discussions on this thread leads to some concrete suggestions/steps that one take to counter an abusive employer. and ofcourse IV should take steps to make these employers visible to the whole community so that others will not fall pray to them.     I have been a member for a while now and have seen the benefits of IV. I've also seen a lot of back and forth in various thrreads betweeen various members in various issues and subjects. Before any one starts checking if I have contributed, let me assure you I have ....for the DC rally. Why? because deep down I believe in this org. No one forced me to contribute, no one asked me to have to come to this or that meeting. I live in Wisconsin but have not been able to attend any sub commitee meetings In Milwaukee because of circumstances both personal and official. I need not explain to anyone in more detail. What I mean by this is we need to set our boundries of expectations. How much do we practically expect out of members and how much can be done by a much more core group. Someone who RSVP but dont turn up should technically be a non issue, its definetly bad for the organizer and the core group, but are we hear to teach people courtesy? Its an intangible expectation. When we set this level of expectation lower, we will strain oursleves to a lesser extent. The bottom line is human behaviour and circumstances that model that behaviour and any other external circumstances cannot be changed.

    I second any idea that keeps membership open and does not restrict access if one has not paid. However in order for any legislation to happen we all know that $$ is the bottom line. So when ever we need it, we must raise as much as we can. We have to let people come to the web site browse and leave at their will. Restricting access is like closing doors and no popular internet model works like this. Take google, yahoo, hotmail, everythign is still free and has been free and is the most popular. Open source is also more popular than paid software. We have a majority of members who log in from the office or home, and we have to let these people in. Our successes should inspire people (it inspired me) to pay. I will contribute again and also join my state chapter very soon, but my only gripe is when we have emotional members who role play people and call other people names. We dont need to go there.If we are arguing over the internet like this how long will it take us to break into a fight in a state chapter meeting?

    Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment? :)

    Why do think that "India" is the name of 1 human being that everyone from India should be treat like 1 person. Each person applies for his/her I-485, even each member of a family is considered separate. So why club one group of people based on a dichotomy that works best in your favor and then argue that there should be no change. Why not apply color of skin to decide the limits, or maybe the language. Because frankly, which country I come from has nothing to do with why I am here, just as the color of my skin or my native language has no relevance to my petition. In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system? Why not say Tamil SriLankans will autonomously govern 86% of the land and rest of people in Sri Lanka should migrate to the remaining 14%. Is that how it works there? Probably not, then why argue for something which is actually nothing but preferential treatment. That's ok, in olden days, when racial discrimination was legal, people who benefited from it argued in favor of it, just as you are doing in favor of per-country limits. But the society is much better without racial discrimination. Don't you think so? Any special benefits accorded to one set of group over the other is preferential treatment. There is no other way to describe it. Now, if you got a job, which is why you are here, based on the fact that you are from Sri Lanka, then it is a different thing, then you must get green card based on which country you came from. But it would be illegal if actually you got got your job because you are from Sri-Lanka. Then why apply the benefit which is a direct derivative of your employment (and hence employment based green card) based on which country you came from? Is there any relation between your job and your country of origin? If yes, then it is illegal, if no, then why give benefit of your employment based on your country of origin, if no, and you continue to want the benefit of your employment based on your country of origin, wouldn't that be asking for preferential treatment? How else will you chose to describe it? Please help me to understand this.

    Look, I know removal of per-country quota may not work in your favor so you do not want to remove it. Tell me that it is not true and this discussion is over.     I don't think H1B is law is that complex, it just says to get some skilled foreigner to work if you have a position (contracter/fultime/parttime or whatever it is) to pay for that. Thats it. So any US employer can apply for H1B by declaring his will pay the wage mentioned in H1B LCA.

    H1B law too broad. It didn't filter any. Thats the reason some are abusing it.


    To the best of my knowledge (correct me if I am wrong) H-1B can not be applied for contract worker if the visa has to be applied on demand and bench is not allowed.

    How will contract wokers come here in the future?

    Yes, it says "derived from" it does not say "equals" or "mirror"...Many times CP dates align with AOS dates and many times do not.. so Let's wait. If it will mirror this time we all would be glad.

    I am kind of curious about onething - why is IV core is not saying anything about current house committee deliberations? - did I miss some posts. I am not trying to criticize or anything but just trying to understand if we are getting excited about something which is destined to fail already (I made all the calls and also personally made 5 others to make calls yesterday). If its a strategy not to discuss too much its fine with me - hope there is still a fair chance for 5882.

    I am bumping this old thread since I might have missed something in this discussion.

    Some advantages of staying on H1 stated earlier were:


    Pros of using H1B:

    1. If I-485 denied or having issues in getting approved, then you can still continue with your H1B and have peace of mind.
    2. You can bring your spouse / dependents using H4
    3. Getting Driving License renewal up to the duration of H1 is not a problem.
    4. Can renew in 3 years time period after I-140 approval and can avoid frequent renewal of EAD hassle.
    5. EAD renewal every year is expensive and can save money!


    For me:
    (2) is invalid (Already married, wife on independent visa)
    (3) don't know (Heard it's more flexible now, so willing to take this risk)
    (4) USICS started issuing 2 year EAD, so the difference is only 1 year additional extension with H1 (Not a problem for me personally)
    (5) is invalid (Most of us renew EADs even if we dont use them)

    which brings me to (1). How does having H1 give peace of mind? Hypothetically, if 485 is denied and H1 was extended beyond 6 years based on a pending AOS, is it still valid during MTR/Appeal? If it is, since EAD doesn't provide this privelege, I think this is the only reason why people should stay on H1?
