    I got a letter from IRS stating they have notified the employer to send the corrected W-2. I should be waiting two weeks before the due date and then use Form 4852 to report the correct wages. This has become a stress for no-fault of ours. If the employer provides us a corrected W-2 after we file our taxes and if the figures don't match then we should amend our taxes using 1040X. I am sure the employer will wait till the last date or near to due date to give us a corrected W-2. This is a real pain in the a$$.

    There are many possible explanations of why they are willing to make changes to accomodate the illegal immigrants.

    off course its the vote bank politics but I think psycologically nobody is intimidated by ppl who come to US and are happy to do low-skilled work. They don't work in high-skilled or unionized jobs. They are largely employed by restaurant, cab-companies etc. These are jobs citizens really don't care for.

    Whereas the job that H1 workers have... most ppl (in theory) would like to have them. It remains debatable how many native-born americans actually want to take hardcore technical jobs.

    I am in the same situation with H1/H4 extension receipt dates of Dec 21,2006. My current H1 and wife's H4 are expiring in June 2007. I dont think the H4 will be approved before Apr 2007. My company wont sponsor for premium processing neither its allowing me to pay for it. Can we just file for H4 to H1 under regular processing and submit the H4 extension approval once we get it approved. I am sure it will take them atleast 5-6 months to process regular H1 filings. Can more documentation be submitted to USCIS based on the receipt notice without them asking for it. I am just worried incase her H1 is approved without an attached I-94. It's a nightmare to go for stamping back home. Any suggestions/views?

    As another member already indicated , I already mentioned my PD, country and EB category in my post.

    Anyway, I had already waited 7 years in the GC process before recently coming across this forum and choosing this handle name when joining. Guess you could say that I was prepared to dig in and stay for the long haul if required which is why I chose that handle name. A few ups and downs/ forwards & backwards (even if in years !) in the priority dates won't deter me much now :).
    Although, I could just be drunk with euphoria of my PD becoming current in March and blabbering away pompously. So don't you steal that login (pessimystic) away from me ! I reserve the right to choose it if and when I feel so :)

    I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.

    We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.

    Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.

    Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.

    In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)

    [Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]

    In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)

    In both the cases, US is a clear looser by not taking advantage of the skill sets they have.

    Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.


    Suppose IV decides not to focus on I-485 filing but some other issue. By this analogy, all members with interest in I-485 will leave.

    What will be my status after i file my I485?

    My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).

    I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.

    So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?

    Appreciate any responses ...

    Your question is not clear but when you say I-94 I assume you mean the I-94 that you got the last time you entered the country, right? The expiration date on that has nothing to do with your status as long you have an approved I-797 for your H1B extension till April 2008. You are in status till that time.
    But you do need an unexpired Visa stamp on your passport if you leave the country and want to come back to the US.
    So the way I see it, even after filing 485 you will continue to be in status till April 2008 and then I am sure you will extend that for another term if your I-485 is still pending.
    As for going to Canada to get a new I-94, it may not work because they do not make you surrender your old I-94 when you go to Canada and so therefore do not issue a new I94 when you return after a short trip to Canada.

    Yes. GC is always for future employment.

    Changing citizenship does not affect how Priority Dates are recaptured.


    13) when do the dependents' citizenship come into the picture in the GC process? If I continue to be an Indian citizen but my spouse becomes a Canadian citizen, will my approved Labor/I-140 be affected in any way?


    It is country-of-birth that matters. if your spouse is born in another country that is not subject to PD backlog, you may apply your I-485 to your spouse�s country of birth.

    Not simply because she applied for her SSN.

    The EAD kicks in, once her employer fills out her I-9 using her EAD as permission to work inside the US. If she holds multiple jobs, then entering EAD into one I-9 will mean she has to ensure that she has all her I-9s from all employers updated to the EAD.

    At this point, the H-1b is no longer used, but does not get cancelled (unless the employer revokes it). It just goes dormant and can be revived again by filing an extension. Another way is to go out of the country and return using the H-1b visa.

    You should be allocated a visa number if nothing is wrong with your application... If its quite old as it looks to be, they may issue an RFE for EVL.. and you can respond asap and still be optimystic.. Chances are high that you'll get a Visa number assigned to you if the quota doesn't finish in the first week of March... Actual approval can come months later even if the PD has retrogressed...

    So chill and prepare for EVL or straight approval...

    Name check is irrelevant now.. Its 180 days from when FBI name check was initiated.. Its normally around your Notice Date...

    Though my PD is quite old , I didn't get to my I-140 filing until Jan 2007 thanks to the labor certification backlog hell. It was filed premium and approved in Jan 07 itself. And also my I-485 was filed in last week of July. So the information USCIS has is kind of recent. And I have stayed with the same employer so far (One of world's well reputed & largest IT company)

    I hope they look at these facts and dont bother sending an RFE or EVL and send me the straight approval ! (Fingers crossed and touch wood and whatever else !)

    Yes sw33t, it indeed redirected me to some site by popup, it was one of those virus which is embedded within images. I immediately knew what was happening by noticing the performance of my system, but even then it was too late - everything was frozen!! Then began the painful recovery process... Sigh :p

    NOTE: It also hijacked Firefox, every time I use it, it freezes up the entire system and again I cannot re-boot, so for now I uninstalled Firefox and am using Google Chrome. So sw33t, please do something about it if you can :confused:.

    I dont think that revoking I-140 by sponsoring employer has any affect on the your process if you use AC21 after 180 days...Not sure about the before 180- days situation though !!:rolleyes:

    I'm not doing any favor to any body and I'm just protecting my life and my friends life. Why would any H1 guy take that risk even if his Green card application is pending and even when he is discriminated purposefully based on his country of origin in POE also in USCIS? These two issues are interconnected to each other such as buying a house for living long term in US and his application is pending due to failed immigration policies even though his employer is interested to have his services at higher priority. When few rude CBP officers don't let him to enter in to US even if he has valid VISA to work in US and even if his company needs his valuable services to the slowly rising US economy, what's the point in buying a home even though selling can be done through some Power of attorney at loss in future from home country (it becomes biggest blunder of my life if I do that) ?? You would realize when it becomes your turn at the POE. 1% will become 10% in no time if you don't react.

    It sounds like your argument is like my granny's old saying 'Cat(who is considered as thief in that neighborhood) jumps in to somebody's kitchen, drinks milk by closing her eyes and she feels that nobody is watching her'. I can't make that risk by buying a house in this limbo situation though I have an interest to live in US to realize my American dream since my childhood.

    Yes Sir, very true: "People do not buy house to sell it". I am not suggesting that you buy a house and sell it, I am suggesting that in case you plan on buying the house .. don't get intimidated by the bad immigration experience of few folks. My point is that in worst case scenario, if you have to go back to India (which is less than 1% chance), there are ways to deal with house situation.

    Last time around exactly the same time in 2006 CIR took off like crazy because of the tremendous backing of Senate Judiciary committee chairman Arlen Specter and Senate majority Leader Bill Frist (who actually gave a deadline for a the bill to be introduced to the senate floor, to speed it up) and president bush supporting it as well. In spite of all these it took the senate from Feb-march 2006 to around September 2006 to get it passed.

    Now to the present situation, Harry Reid, the current majority leader never ever publicly spoke one good word about CIR, the present senate judiciary committee chairman, Patrick J. Leahy has not displayed even 1/100 the urgency nor the interest in CIR that Arlon Specter displayed, president Bush though still supporting CIR is a wounded president licking his wounds and has truly become a lame duck president (most unfortunately for us).

    Having considered the above facts what are the chances of CIR happening? Its very painful to say that but I think very low. Even by a miracle (a very big miracle at that) if something happens it will be November or December 2007 before it passes.

    As if this not painful enough there is a 60 day waiting period from the day the president signs it before it becomes a law. I think there is some confusion on this 60 day period (I am not 100% sure on this). In addition to it if I remember correctly there was a strange condition which was something like there would be a 6 month investigation period to determine the effects of CIR before becoming a law. If you add all this nonsense up I think in the best case scenario January or February 2008 before CIR becomes law and worst case scenario July or August 2008 to become a law. just my 2 cents. I can only pray and hope I am wrong.


    Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.

    Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. The whole point of having a committee is to be able to either kill the entire bill, or a congressional appointment before such a bill / confirmation is debated by all 100 senators. Same thing in the House.

    If it was possible to bypass committees, then people would have floored the SKIL or other bills directly on the floor of the house, therby bypassing Jim Sensenbrenner and his Judiciary committee last year.

    My PD is in Feb 2005, hence downloaded the 2005 MDB, did not find my case in there and to my surprise haven't seen any cases from the backlog centers. The database for 2005 contains only 14000 records, can't believe there are only 14K cases filed in 2005. Am i missing something ?
