The basis of their Diversity Visa Lottery program.....is diversity....if they remove country limits - that would be contradictory to their very core belief....
Though if you thing of it, AC21 did do that - remove country limits....Heee Heee....albeit with the excuse that ROW is not using it's quota....US Congress can do what they want...they just need the motivation (money form lobbyists, Ha Ha!)

As per INA/USCIS, many of the following won't qualify for EB2:

Many of the eb3 people with earlier pd are in the current mess because lawyers thought eb3 was the safe way to get gc! Now, we are stuck and they are making money of us!

it might sound cliched by now, but what IV has achieved so far is truly unbelievable, especially given the historical laissez-faire attitude of our community.Remember what this group is essentially about : a bunch of people fighting for their just cause within their limited rights in an alien country. Its a huge pity that all those folks who think of IV and their GC as their entitlement get a free ride through the blood and sweat of a handful of people, whom they accuse of incompetance and worse. Great job core team .. with all this effort, success of some sort is inevitable.

My Lawyer does whatever my employer tells him. They never give any receipt notice or approval notice to employees.
They did not even let me file my EAD and AP along with I-485.
I can file EAD/AP myself but I'm worried they might not give me the receipt notice of my I-485 filed in july, in a last ditch effort to prevent me from fleeing(I don't yet have any intention btw) or atleast make it difficult for me.
I'm sure there would be many in this situation.
Any thoughts what can be done?
IF you have used your personal checks the receipt is usually at the back of the checks. Esle just call the help desk and give all your information and if the guy is in good mood he can provide you the receipt number.

Exempting spouse from annual quota has been IV's active legislative objectives for some time. I think that was incorporated in last year's failed CIR.
In current congress's CIR (which was very bad for all of us; fortunately for us its failed) discussions a bunch of senators argued very strongly in favor of family based immigration. It would interesting to see how these senators will react to this proposal - after all spouse is the most immediate of family and exempting them from annual work-based quota seems quite logical. But again its not about logic its all politics.

The last point depends on the university. Many accept EAD as sufficient for qualifying as an in-state resident for tuition purposes.
At least, one I am in contact with does.

That article is a joke and more like propaganda. It says around 58K H1Bs are issued and most of them are extension - but are they not aware the extensions are not counted towards the cap...?

Babu, thanks for confirming that this stupid rule is in fact true. I always wonder how USCIS gets crafty in making new rules.
It will be easier to just get the stamping done in INDIA. That way, will get stamp till 2010.
Looking at reply from Babu. I think Babu. got I-94 corrected through Amended H1 (INS) . and then travelled to INDIA. While returning from INDIA
by the last updated rule He would have retuned with a valid I-94.

Folks, the idea of this thread was to appreciate what Pankaj did and i am sure everyone agrees with me that he did a wonderful job.
To do it or not to do it, is a totally different thing.
This is a learning process and this rally was done for the first time. So, there were a lot of lessons learned.
We will do a better job in the next rally.
Instead of worrying about the rights and the wrongs, lets spread the words, lets get some more local lawmakers meetings, lets educate ppl about the issue.
Come on folks lets use this wonderful oppurtunity to advance our cause, lets use this positive energy to educate ppl more about LEGAL IMMIGRATION.
IV is a platform where we can unite and get things done together. IV does its best, but IV wants individuals to try at their personal level.
Come on guuys so lets start working on positive things and lets keep on moving forward.

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

I wish things could work out for you in US. It is sad and there are thousands of people like you with badly affected personal lives due to the broken immigration system. A lot of my motivation to work for IV also comes from coming across people like you and thus feel strongly to do something to solve problems affecting each one of us in the IV community we have all built. When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?

I did. Changed to same/similar job (exact same description). Old employer not revoking I-140. lawyer has asked me not to send AC-21 letter to USCIS, wait for the RFE, if any. so sitting tight.
Moved from H1 to EAD.

Here is my situation, someone please suggest me:
I am using EAD to work for my GC sponsoring company and I got laid off. My HR says that they are going to inform USCIS that I am no longer working for them. HR also says that they won’t cancel my approved I-140 and going to rehire me once I get the new project.
My question:
When I joined them there is information to USCIS.I just filled I-9 form and gave it to the company, no information to USCIS. Now when I got terminated what is the need for the company to inform this to USCIS? Anyhow I am going to join them once I get the new project in couple of months. Is it a new law? Will there be any problem at the POE if travel outside US and come back using AP? Is there any chance that USCIS sends me RFE?

If you are not on H1 there is no reason to inform the USCIS. Make sure that they are not including your I-140 receipt number or A#.
Actually informing that you do not have a job is sufficent to revoke your I-140.
