You can keep your PD if your 140 is approved from your current employer. I know of a person who did this succesfully.
But I believe you need to restart your greencard application from scratch.

I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)
I have a few questions;
1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?
2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?

Total AOS applications pending as of June-2008 is 740,969.
What percentage of them is Eb-3? where did you get that 55% from?

I agree with you. But i made those comments immediately after reading that other post. Those comments are not good for any EB2-I. He/she should not post like that.
We all want our GCs come ASAP, but one should not cry for other's advantage. Otherwise i am OK to fight to bring justice to all.
Those are not nice words. You can always tell that person that his/her logic was wrong but don't say that EB3 folks deserve the long wait. If everyone of us had applied for EB2, then EB2 queue would be in the same plight as EB3 today, don't forget that!
And realize that most of the EB3 folks actually deserve to be in EB2 but for their respective Organization's policy to apply for EB3. I mean to say, it wasn't an option for many.

When I was asked to resubmit documents after the interview (via drop box), the consulate said they will need 6-8 working days from the date of receipt of the latter. They indeed took only 7 working days.
Also, I believe they must already have done PIMS verification in my case since they asked for additional info 16 days after the interview. So in total it took them 29 days ( incl weekends)
In your case, it doesnt seem they got enough time to do PIMS. It is hard to
estimate the delays.

I recently saw one case where an H1B application was reopened. The LUD was updated even after being approved more than a year ago. The reason was that the company had applied for an L1 visa for another applicant and the case received an RFE and all other immigration cases of the company came under review. The new L1 visa case was denied but the old H1B approval for another applicant did not get any denial or RFE. So make sure you work for a good company and have a clean immigration case, else there are some scares along the way.Thanks Pappu.

Bashing the system and correcting the imbalances are correct. But some people in this forum are targetting individual persons(some times Senators) and doing personal attacks some times bad words also(I can see atleast 100 postings like that). No one realise the fact that same right we were not able to get in our own country. Can anyone talk to MLA or MP in India by phone when they want if any issue?. So we need to appreciate that we got extra freedom than our own country. If we want to correct problems in the system we have to fight with patient with point in mind that we are aliens compared to those who came here 20 years or 100 years before us.
Everyone on this forum or at least most of us on the forum know what are the downsides in indian system. Every one can write thousands of pages . I agree with you that India has problems and I am the first one to agree.
The momemt one starts comparing both countries , It is a race to bottom. Hope you understand.
At least personally I have so much respect for the system. Dont think that who questions an unfair system is less appreciative of USA.

I am taxed every month for social security though I am not eligible for any of those benifits as of yet. I always thought if that is the price I have to pay to make America my home I thought I would do that happily.
I still have beleif in the system and hopefully something better comes out .
I am just writing this email to complete my civic responsibility and If I dont speak out nobody will speak on my behalf.
I would appreciate if you can educate some people like your dad ...

Its a very tough business to calculate the dates or numbers...
First of all nobody gives an actuall count of cases accurately...
Nobody know how many cases pending with USCIS...Nobody knows
how much would be PD based distribution...Nobody knows how many
people got LC but who cant apply for I485 because of retrogression..
We always thought that there is 360k application in BEC and since those LC have PD from 2000 to 2005 there are no chances of fast movement of PD in year 2007 especially for EB3 and EB2(Indian , China).
After reading this news it seems employer withdrew many cases, which they filled for employee who no longer work for company, so certified case is going to be only 100k, much lesser then 360 k. How many more years it will take to clear these 100k LC? I don't think it should take more then 2 years...

With ICICI it was extremely easy to open a loan,they even opened the office on a Sunday to get it done.
But they are making it extremely hard to close the loan.
Couple of times they send us letters asking us to do outstanding payments when there were no outstanding payments. Then we went to the branch and sorted out and manager gave a letter confirming everything was clear.After an year we get another letter regarding the same payment and again we went to the bank and bank manager apologized when we told we are going to file a case.
Also we saw few other customers there with the same issue while waiting.
Now we trying to close the full loan by paying off everything but the bank says if we pay in advance there is a big penalty.
These guys are too much.

Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.
Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.
With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.
With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!
Your theory that land values never fall in india is not true. Here is the proof. It is a question of affordability. Even if the population explodes and since most of them are poor, there is no justification for such high price appreciation we had in the last 5 years.

K , I see two views by two different types of folks.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.
View #2: Some people come resigned with the idea that they will be looked down. Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Seriously, If you really believe what you are saying why do you even want to be here now? or why do you even want to have a backup plan that will again make you a immigrant some where else?? $$$ over ride self esteem Huh? In the name of discussion you want to shape the opinion of people who do not talk much. Kudos to your agenda. I compared the president to show that immigrants and sons of immigrants can have a life that is quite opposite of what the OP said. Just because you or some one you know treated some one bad does not mean that every one treats others the same. B T W, There are others in congress who are born out of country as well and there are governors born some where. stop smoking too much
B T W, All of us know that immigration in the US is broken and we want to do our best to fix it. You can chose not to do so. Did some one say that you have to get a life because you chose not to do so? Yes, there are many other countries that have smoother immigration process. Every one is welcome to explore them and you did. In fact, IV wiki has sections dedicated for immigration to other countries. You can chose to develop them or can chose other wise. Just because you have explored other options and found some thing that suits your situation does not mean every plain jane can and will find one. You expect the US congress to get its act right, modify the immigration system and have all of us walk on a red carpet. That would be ideal. Even I will love that. As that is not the case and some of us has chosen to work with the US Congress, you consider us folks who dont have a life. It comes down to the difference that you dont want to work on this issue and have things served on a silver platter, while many of us want to work and fix this issue. Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

These before Nov2001 applicants reasons could be labor substitution (LS) or stuck in FBI/NC or other GC initiating/140 marriage delays...and therefore got a chance to apply in June/July'07 fiasco..along with their spouses..
