One possible reason is that Americans just don't want people smarter than them to come here and have the high paying jobs, create companies and have success on their own country.
It's OK to have a bunch of illegal immigrants to do the dirty work.
Let's think as a modern slavery. They want to be in command, to be the boss. It's their nature. And they just don't accept skilled immigrants coming here and taking the top positions from them. They want people who just take orders - from Americans.
I dont agree with that coment. Whether it is an american/foreigner, if you are not suitably qualified (work skill and knowledge + Social / managerial / personal) you are destined to be in the recieving mode all your life. Now I do agree that being in a foreign country, always it would be easier for the natives to reach the managerial position faster, compared to a foreigner. So what we can do is improve our skills and be more confident about ourselves. The american citizens have been exposed to years of economic prosperity that has lead to the belief that even if they dont study / work hard the country will provide them the jobs to enjoy life. When suddenly they find that they are not enjoying the same liberty (chaning jobs as they wish, bargaining for more pay, employer at employees mercy kind of thing) they are unhappy and are starting to complain. Now regarding ilegal immig doing dirty work, its not the fault of the american employer. Its because the workers find, what you call as dirty job, better than what they have at home.

According to what I have read - porting of PD can be done at 2 stages
1. At the time the second I-140 is applied or,
2. When one applies for the I-485.
So you should be fine going by #2. Not an attorney, just like you all - a GC aspirant commenting on his research.
My question is the same that you raised earlier - the Memo states that the PD has to be current when interfiling. But in the case of pd_recapturing, his PD is May 04 which is not current - EB2 for India is Apr 04 (my assumption being that pd_recapturing is from India.)
My case is exactly as pd_recapturing, waiting for the approval of my second I-140 to see if the date got ported or not (we had requested during filing of second I-140). After the approval, I was thinking of waiting for my PD to be current before filing.
pd_recapturing - we'll be following your lead to see how your case turns out.

Hi. I don't know the answer to your first question but from what's I've read, anyone who is adjusting status needs to do fingerprinting and it's done every year until greencard is approved. For your second question, a person needs to fill out I-9 form (http://www.uscis.gov/files/form/i-9.pdf) through employer to activate EAD. For your third question, you can search the threads for late june filers. You might find the answer in all their replies there. Congratulations for getting your EAD. We're still waiting for ours. :confused:

Nobody from IV has prevented people from other countries from speaking up. On the contrary, multinationalism is only encouraged to give a global face to this issue. But, I don't see anyone from outside India/China bolstering IV's efforts. Why don't they step up and join the core team?

I urge you to ask for second opinion. From my understanding it depends how long your I-140 was pending.

We are in exact same scenario, but was thinking that H4 holder has to enter using AP to continue to use EAD after "vacation" . So is it like, Use H4 for travel and EAD to work, instead of , Use AP for travel and EAD to work? This will be of great help to many people who are scared to use AP or not want to face the extra half hour at immigration counters.

Should there not be a separate Green card quota for anyone with a USA Masters Degree in any field?
If USA does that, more people will pay to come to study in USA. Not go to Australia, UK etc to study. So more money to USA. And USA degree holders will be able to use this education and work in USA to improve USA economy. If they go back to their countries, then USA has brain drain.
If they have separate quota for H1, separate H1B quota for Masters Degrees, what is wrong to have one for Green Card?

My AP online status says mailed on Sep 11 th. I have not received them yet.
My wife AP online status said Sep 11 th. We received them on Sep 21 st.
Even mine was approved on 18th september...Neither me nor my attorney has received it...It's frustrating..I have to travel to India next week..
I received my EAD card in 4 days...I don't know why this is taking so much time.

The school is wrong on 2 accounts:
1. The only exception to the full-time student rule on F1 is your LAST semester of graduation. If your wife is in her LAST semester, and she has fewer credits remaining for graduation, and enrolls in less than full-time credits she CANNOT be out of status. I myself was in that boat in my last sem. Not sure if things changed in the past 2 yrs.
2. If she has an EAD, then your lawyer is right. She is not required to be on F1.
I totally agree with what was said by she18. If your are in the last sem and don't have enough credits to be a full time student, they need to update the same in SEVIS and continue the studies.

You are correct but I think I am not sure if one can change employer (H1B Transfer) during that 3 Year extended H1B period after 485 denial.

The con's mostly depend on whether you have already exhausted your 6 years of permitted H1B.
From my understanding if one has approved I-140 and I485 pending > 180 days, 6 year limit on H1b doesn't hold. At my present employer I am on h1b and this is my 9th year. I am quite sure a lot of folks on the forums are in the same situation.
Does anyone think it would be problematic to transfer H1,
if the person is in the > 6 year of stay on H1B
has approved I-140 and
I495 pending > 485 days

I really appriciate the work of the core members.
i actively particiapted in the tech workers yahoo group, irrespective of hard work by many it failed to make a huge impact, probably because of lack of clear leadership & focus but in the case of IV, the core team's active role and leadership makes our voice being heard in the media and in the US congress.

*) Have an emergency cash fund that would last atleast 6 months without changing your lifestyle. If you lose job, a bit frugal living could stretch that 6month fund to 9 or 10 months. (this could be cash; or assets that would not lose their value and could be cashed at a short notice.)
Do not leave this entire fund in a checking/savings account; nor put it under your mattress.
Have some cash at hand ($1K or $2K); - this is to avoid ATM issues, run on the bank etc.
Put some of it in a 3 month CD;
Put some of it as precious metals (gold etc) - this will protect you against the dollar losing its value, yet the metal is easily saleable.
Put some of it in a money market account that yields a little better than the savings account, yet immediate cash availability.
Distribute your savings between atleast a couple of banks. (If a bank goes under, I do not know how long it takes to get access to your cash which is FDIC insured upto $100K (250K under the bailout plan)).
*) Credit is really tight right now. So... if you have any good offers of pre-approved credit, take it. Keep it aside.
*) Do not worry about your home losing its value. Enjoy the house; hopefully it will appreaciate back to your purchase price in a couple of years.

They are very smart. They know your weaknesses. Unless all so called high skilled use their little skill and go to the street and ask for justice, they will favor illegals. We don't have God fathers !!
I am very much surprise that media also overlooked the injustice to the Employment Based Immigration.
I just don't understand one basic question.
Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????
