So does this mean I am stuck with Company A till I get Garbage Can I mean GC ?
You are not alone in this situation...I switched couple months back while I am on 11th yr
H1B. I was with same employer for 8 yrs and applied for 140/485 but both got denied as attorney made a mistake in labor and 140 stating that I will be working only from my employers chicago office and eventually my employer closed chicago office before my 140approval and USCIS raised RFE for that and denied stating that my application is no longer eligible due to closure of office....So I hired an new attorney and filed appeal. Meanwhile I started all over again with another employer and got new labor/140 approved and switched recently. Now I am on 11'th yr H1B.
Now to answer ur question on what if previous employer revokes your approved 140, it will not effect and you can still retain and port the PD to the new employer at the time of filing a new 140 with another employer....what that means is that you can still switch the employers and still retain ur PD

I think your company HR should get convinced for filing in EB2. The lawyer will hear what your company HR says. Yes its salary and designation that matters. I think a Senior with Masters and good salary can ask for filing in EB2. But if your HR by rule has decided that your position does not require Masters then you cannot file in EB2.
Most of the big companies have this rule. If you are with a small company and your access link to HR is not hard then you can convince them to consider for EB2.

Nope ur PD has to be current for them to process your AOS and Aug is already unavialable so there is no way they will process ur paperwork. Also I think within 60 days of AOS you can add spouse. You should talk to a lawyer and not use other people's judgement to decide to file or not to file. But, will there be a scenario where my AOS gets approved before my PD is current AGAIN? That is what I am afraid of.

I prayed god to get my GC before 2008.If God really exists I'll get my GC in 2008.If not it's a proof that God doesn't exists.

Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.

I beg to differ.. My PA DL is based on my Work Visa, hence it expires on the day my visa expires.. I tried to renew online and the system said since you are not a citizen u have to go to the DL Center for a renewal... Maybe your DL is from the time you were student or otherwise...

Dear snehaledu, You raise a good point. Am I IV policeman? The answer is NO. Guess, it is the responsibility of all the members to police themselves. And I saw that it was not happening here, thus my question about the relevance of this thread.
I understood that IV is working on behalf of green card backlog applicants and the intended purpose of IV forums is to provide support for legislative effort. Please help me understand how this thread about $1 is Rs. 44 or whether $1 is Rs. 46, helping in achieving IV goals? I am just scratching my head in an attempt to figure that out. There are many other forums on the internet where you could discuss anything under the sun. There are many other forums where you could discuss everything about exchange rate variations. Why don�t you go and discuss it over in those forums?
Also, we all should be considerate towards all other members of IV. It was my understanding that IV membership includes people from all over the world. It may be true that majority of IV members are from India. Should we as Indians show a bit of maturity and consideration towards members from other countries? Is that too much to ask? Say, if you come to these forums and for 2-3 days consecutively you see a discussion about conversion rate of Pakistani Rs. to $, how would you feel about it as that discussion will not be relevant for you? You really cannot ask for more EB3 numbers or 'treat EB-3 fairly'...Laws are made by the congress and they provided certain numbers to each country & category. USCIS has to follow these norms and apply those numbers and USCIS has followed the rule and have applied the allocatd numbers to EB-3. Problem is not that they are treating us differently or we are getting an unfair treatment. The problem we are facing is because we are just too many in number and the problem is Congress didn't make any laws to provide relief to people if one country or a category becomes hugely backlogged...unfortunately, the Last time they did any law for EB immigrats, it was in 1999 or 2000 when they brought AC21. Since then there has been huge surge in immigration but everytime anything immigration related legislation was brought in congress, it has been shot down..In my opinion we can get relief only if congress acts upon it, USCIS is working the way there were tld by the congress

Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.

am not able to be there these days as I am travelling for work during this time. Also, I have 10k United miles with me, and I would be more than happy to donate it to someone who can travel. But I am not sure if 10k is enough for a round trip. If some one has any inputs on this, I am happy to be of some use at atleast by giving away these miles.

Well my story isn't really as bad some of the stories described here but the last 4 years of waiting for the freaking LC to clear has pretty much screwed up my wife's career. There have been days of utter frustration, fight and bad days for us because of the "dependent" visa.
Its not like my job is great either. I am stuck in the same position for the last 5 years because of the freaking labor certification. Looks like I will be stuck for another couple of years. If I bail out now and leave for India it will be hard to find a suitable position because I have been unable to move up because of GC and at the same time my wife will have the impossible task of finding a job after 4 years of unemployment.
For this reason I am wiling to gamble at least another year or two, so that my wife can work and I can get a better job and then we can start thinking about where we really want to settle :) Gosh, never knew trying to settle in US with a GC will be so unsettling :(

Once again. You will get an EAD ONLY if you filed form I-765 along with your I-485. Your I-140 has no bearing on your EAD.

I can categorically state that once a category retrogresses, any I-485s with PDs later than the cut-off date DO NOT get approved.
This happened to 1000's of us in EB3 in 2005 when EB3 RoW became 'Unavailable' after we had concurrently filed I-140.
Now, this does not mean that processing stops (I got 2nd fingerprinting, etc), it just means that the I-485 cannot be approved until PD is reached. Since my PD (03-may-02) has now been reached, my approval is mere weeks away --- because processing continued up to the point of approval.
Now, Schedule A's of course, benefit from being able to look at TWO categories (Schedule A and either Eb2 or EB3, depending on how their I-140 was slotted). Whichever of these has a cut-off after their PD, will be the category they get approved under.
Assuming you get your 485 approved in a week or two, can you tell us how long it took for them to process your 485? If you tell me your receipt date of 485, that will be sufficient. Thx.
