New way of steady income by means of donations to IV...a new avenue would be ideal.

As long as people support the cause and organization "Willingly" we will have infinite horizons to grow. The moment you bring "Burocracy" in, ultimately momentum will die.. may be slowly or quickly. Historically, IV threads are the major attentive media to declare the existence. We should not kill that with any enforcement of "Paid membership"...It is always hard to wake people. If that would be easy than nobody would have used the word "Struggle"..right:). On other hand yes there is a dire need of increasing financial strength exponentially and that too quickly is at high priority. We need to think and find other ways and resources.

Frankly, after mumbai attack I have been a different person. I come to this forum to learn and provide any information I can provide. But it bothers me to see few jerks like mirage who don't have any clue of how things work, and they just start posting on the forum "remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits" 30 times a day, as if that will be sufficient to remove country limits. Hi core members,
I am willing to play a more active part in this if you can utilise me in anyway. I live in Redmond WA and my wife works in a major software company. I will be completing my 6 years on H1 early next month so I should have plenty of time on my hands. I was working full time in a processor company as a Hardware Design Engineer, most of these 6 years..but unfortunately my GC with them wasn't going anywhere so we decided to move from Austin to Seattle a year and a half back. We didn't envision the retro problem in the Eb2 category and just missed the bus as our PERM filing(from my wife's employer) was a tad too late. My H1 was initially expiring in June so I thought it was too late to apply last year when I saw the retro in EB2. I wish I had applied for my GC somewhere at that stage as I was able to recapture some time on my H and also the I140 filings seem to be a lot quicker this year.
But whats gone is gone....truth of the matter is that I will have to wait for the backlog to clear up...which could take years without legislation.
I would like to play a more active role with trying to garner support for the Skill bill, so please let me know if I can help with anything.

K , I see two views by two different types of folks.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Seriously, If you really believe what you are saying why do you even want to be here now? or why do you even want to have a backup plan that will again make you a immigrant some where else?? $$$ over ride self esteem Huh? In the name of discussion you want to shape the opinion of people who do not talk much. Kudos to your agenda. You keep spitting out your rhetoric that immigrants are dirt but cannot make arguments that hold water for a single second.
I compared the president to show that immigrants and sons of immigrants can have a life that is quite opposite of what the OP said. Just because you or some one you know treated some one bad does not mean that every one treats others the same. Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

Are you working for someone else now and your own company is on the side?
I have wanted to start some business on the side, but thought that was not possible without a GC.
Can you share your experiences on how you did this?

Here's what i did. I enrolled myself as a part time student into an accredited college to pursue MS degree as soon as i filed my LC for GC in Feb 2002. This is what i thougt when my GC papers were filed.
By the time i complete my MS degree, i would have my GC in hand. But i completed my MS degree in Dec'04 while my LC was still rotting in DBEC.
Finally when LC was approved in Aug'05 and i thought of starting my own company before filing I-140. But i filed my I-140 papers in November 05 and started my company in Jan'06 along with one more partner who has GC.
My I-140 was approved and at the same time our own company completed our first overseas transaction.
Now i am waiting to file my I-485. Now i am thinking of doing PMP.
Note: 3 good things happend in the meantime since feb 2002.
I got married and i have two kids.

I need inputs to know what type of company should that be (LLC, S Corporation.. e.t.c.)?
Is it advisable to have a GC holder/citizen as partner?
What form of income should i withdraw(salary/profits/dividends/Interest..) How is the income considered when i file my taxes?
I am not aware of anyone who can sponsor my H1 as a trader atleast for now, if i get the right opportunity, i am open for that

1. If you want to trade stocks only, with your own capital ,then set up a LLC or C corp. If you trade other people�s capital then maybe become a RIA.
2. If you form a llc you become a employee of your own company (say managing director, CIO etc) and sponsor your own H1.
3. You can have a fixed salary and a draw, which is what a typical trader gets. Draw is a percentage of the profits you generate by trading.
4. You don�t need a gc/Citizen as a partner.
5. The company/fund makes money by trading securities and the earnings are retained by the company, you draw salary and bonus.
6. You file taxes as a regular employee would.
7. You might be able to get H1 from a day trading firm, a day trading firm is not a market maker. They trade company capital and typically you have to post some risk capital based on which they will provide you leverage and provide you with equipment etc. You don�t get a salary, just a draw.
But let me ask you something; I am not aware of your expertise in the markets so forgive me if I sound patronizing.
1. Do you have a seven figure capital pool? You will need at least 1MM if you want to make a living trading.
2. Are you aware of the equipment and ECN and direct access software needed assuming you are technical trader.
3. Do you have a prime broker who is going to provide you leverage and settlement? If you have not decided consider Interactive Brokers.
4. What kind of risk management software will you be using?
If you are in the NY/Nj area I suggest try day trading at a firm posting risk capital (typically 10K) then decide if you want to do this full time. It will also help sharpen your skills. If you want I can recommend a few. They will not sponsor H1 though, you will have to have some consultant do that for you.

Here are my case details as well.
Came to US in Aug 1999 on F-1 after B.Tech. Graduated with MS (Telecom) in Dec 2000. Joined a major telecom firm immediately after graduation. My first EB-3 labor was filed in Dec 2001 (Non-RIR) but employer withdrew it because of lay-offs. Employer filed again in Nov'03 (Non-RIR again) and it was approved in March 2007 (after RIR conversion in Jan 2007) by Dallas BEC, followed by I-140 approval (March 2007) and I-485 filing in July 2007. Though my job required a MS degree, my employer could not file in EB-2 as there were people in my team with just Bachelors degree when they joined the company 10-15 yrs ago and lawyer did not advise employer to file in EB-2 as EB-3 was current those days......After surviving 12 rounds of lay-offs, no job security whatsoever throughout and fed up with EB3 process, I changed jobs after 8.5 yrs (July 2009) and my new job required a minimum of MS + 6 yrs of experience and fortunately my new employer (another large company) had no issues re-starting the process again. I work in Mobile Communications R&D (developing networks which support smart phones (2G/3G and now 4G-LTE technology) have been in this field since Jan 2001) and here are my EB-2 case details:

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

Here's an anecdote -
This was back in the late 80s, when I was growing up - in Bangalore.
India had just lost the Finals of a well fought [field] hockey match to Pakistan. We were all very disappointed by the loss, but it saddened me further to see a victory procession with waving Pakistani flags in the Muslim parts of the City.
Ofcourse, India is a secular country and more so the United States.. and you can cheer whoever you please..
But, If you chose to become a US Citizen, and US were in a battle with your country of Origin (let's narrow it down to Sports, to keep it less complicated), which country would you side? If I chose to side with my country of origin, it would make me a hypocrite, wouldn't it ?
