Ron Gotcher said on his reply to some readers questions:
The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1.
May I know in what respect multi-national execs are inferior to researchers?

When every one send individual letter, they will read the first one and then will just ignore others. Because the content and issue is same. When we 50+ people send one neatly drafted letter...I am sure it will draw considerable attention. Ron is willing to help us. I am not sure if we need to hire him for this. If so, how many of you ready to share the expense.

I took an Infopass to find the status of my application. IO told me that my file has been moved to an officer on Aug 26th '09. wondering why it has not been touched since then.

Can't pick stocks in this Volatile market, but one thing is certain the markets will be volaile for some time now. So I suggest be long Vega. Pick a stock where the implied vol is higher than historical vol (you will find plenty. Eg C) and put on an option straddle. Sure to make money.
This is not a day trading strategy but a derivatives trade.
I can post a few breakout runners in the AM but would like IV core's consent to do so. I can post runners in the chat so its faster and easier
Once I get a go ahead I will post some
I strongly suggest to WATCH WATCH WATCH the trades and not jump without knowledge of the trades.
Again make a portfolio on google /yahoo or any other portal and watch the plays . Keep an eye on the volume / News of the trades.
Just a side note :
SAY - Satyam went into the dumps from 12 to .01 IN 2 WEEKS . NYSE dint trade it for 3 days . Today it opened again at 1.10 ---hit bottom of 0.78 and high of 1.77 .
So a PDT watches for these breakout . If any one entered this stock at AROUND 1.00 earned anywhere from 50-75% on it.
Why did it rise ?? Market plays on humna sentiments ...early morning news broke out that there "MAYBE" a govt bailout. sending SAY skyrocketing.
Traditional investors may differ from my opinion....but then This is not for traditional investors sorry!!!!
If you ask me ....I suggest just use your disposable income ONLY STRICTLY to play to learn . Start with as low as maybe even 500 bucks .
Initially just play on the portfolio without money to see how you fare. As you learn you will be more confident

Weldonspring,
I am on the same board. I am also planning the samething.
1) After 11 weeks that is next week Friday call the customer service and raise a Service Request
2) Within 2 wks no response, on 90th day I will walk into the local office (SFO) and ask for interim EAD.
3) If Still create the issues, packe the bags and go back to home country. It is really bad,
getting frustrating for everything no regulare process and always waiting.
So I give up, I applied on april 1st and still waiting no updates:mad:
Agreed it's frustating, but I wouldn't give up so easily. i would continue working if they don't issue an interim EAD, if that becomes an issue later on (very unlikely that USCIS will figure out you worked during the EAD gap, do you believe they are that efficient?). The worst that could happen is 485 denial. at that time you can explain (to the court if necessary) that it was the USCIS who delayed processing on the case causing the gap in EAD's. BTW, upto 180 days of out of status stay, work without EAD etc is forgiven.
Cheers.

1) Fast-track GC process for Masters degree holders from US universities. This will be the least controversial, boost admissions (and money) flowing into universities, and clear up backlog in regular GC queue. Its a win-win and most senators, congressmen have voiced support for it already. We can get very good support from University lobbyists also (if they exist!!).

Thanks for the post, i am interested too, i am not a pattern day trader but a normal trader as of now.
Could you please post how this has affected your tax return filings, do we need to do something extra while filing tax returns if one is a pattern day trader?
Whatever you earn from Trading is taxable as your earned income. On the flip side if you ve made losses there is a provision for some tax deduction as well . Contact a good Tax consultant
I believe that I will pay tax only if I earn and I will definately earn more than I pay tax
Also it suggest that there should be minimum equity balance of 25K, are they referring to the value of stocks...
Yes for day trading you need 25k but you dont need to have 25 k . For starters I trade something where I buy EOB today and sell off SOB(START) of business tommorow
I recommed reading day trading concept at wiki I will post some rules as well as ways to trade like PDT with a smaller account
Yes as you said i too was thinking about it, there is only so much one can earn because in my situation i cannot shift employer, nor does the current one pay me enough or is willing too, so we all must look at alternate sources of income (but take our own risk and decision)....
Welcome aboard friend same situation here
I started trading with sharebuilder recently.... and they did give me a 50$ coupon to start with...
Thats great ...I know a few trading sites offering very cheap trading fees
As pappu said, yes we need to share such info with our fellow folks so that everyone gets benefitted and if we make money we can contribute atleast a small part of it to IV.... (win-win for all).
There is so much information to share....

Both in the job advertisements and Form9089, it is said: minimum of master degree or alternate of bachelor degree plus 2 years' experience.
The LC has been approved in the August of last year, I-140 (EB2) has been filed thereafter, still pending.
How do we file a new application for Eb3 since the original LC has been filed in the last EB2 application?
Is there a way to file an amendment of the pending EB2 to EB3? In this case, can we hire a new lawyer?
Some people has got a RFE, but some just got denied directly, so I am worried.
Can I hire a new lawyer to file a new application for Eb3 using the same LC? but we do not have the original LC? I remember I read somewhere that if we file a new application with request of a duplication of LC, then we cannot file I-140 and I-485 concurrently. In my case, I am desperate to catch the deadline of 8/17, because my H1B is going to expire and reach the maximum.
Please help!
1. What was mentioned in the job advertisements - was the alternate Bachelors+2 years mentioned
2. How long as it been since the last advertisement
3. Can they file another I-140 concurrently with I-485 using the recently approved labor
4. I agree with abhijitp you can get a RFE too
My suggestion would be to apply in EB3 even though the job advertisement reads masters or Bachelors with 2 years and use the option 3
I request you guys to consult a good attorney immediately and help your selves and also save time.
Please consult an attorney for your good.

The whole GC system is not fair ...
1) Country quota -- People from smaller countries get it very quickly while ohter keep waiting forever ....
2) Assume I applied in 2006 NOV ...lets say my friend applied in 2005 NOV ..his/her spouse comes to US in 2009 after getting married and he/she gets GC first before me ...
3) People struck in back logs ...most unfortunate guys of all
4) People struck in FBI name checks while others who appled after them keep on getting GCs ...
List goes on ............Hope some day it will become strict FIFO across all countires and it will become predictable ...

Guys,
Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?
She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.
We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?
A lot of you may have experienced the same dilemma, so please let me know...
thanks.
Not advisable until you plan to stamp H-1 visa and come back on it.

...who said that they are from non-IT field , it suggests that more than 90% affected are from IT and EB2 ? I want to see hard numbers....
I am not sure what you are going to achieve with the field type. You have to consider some inherent facts about the Employment Based immigration...
1) Most (not all) applications are from India
2) Most (not all) applicants from India are in IT field
3) Most applicants, in general, are filing EB2.
If you consider all these facts, it becomes apparent that IT/EB2/India is not something they are purposely focusing on, it just happens to be that way. If you want more information on this data, I suggest you check out '' that shows Country and EB type by each user and whether they got audited or not.
I dont think we necessarily need people to describe their field for the initiative we plan to take against late audit responses.

It looks like most people want to believe just what is good for them. I have yet to see the document that says "It is illegal to issue interim visa bulletins or stop accepting applications mid month".
Don't kill the messenger.
Be concerned and be VERY CONCERNED. Being in denial will not help. Work with the assumption that the dates might go back any time. If your conditions does not permit you to file in the first week there is not much you can do. Tough luck if the dates go back. But if there are things you can do , please do...
I will give you an example, It is very difficult to get medical appointments where I live and the first opportunity was July last week. I traveled 120 miles (not much) and got mine done last week, where as a friend of mine did not want travel and took the local appointment for Jul 3rd week assuming he can file by Jul31. With the change in dynamics he has to revise the plans and may not get the appointment 120 miles away.
I mean to say, work with the goal to apply ASAP.
Good post . ANy thing can happen and you got a chance after 2 years to file your 485 ..Do what ever you can and file. You may hardly loose 1 grand if you pay premium for all services
