i am not sure if any one of you has tried donating blood in the US, i have, and have been refused a couple of time for reasons ranging from
you have been to india too recently, need 12 months of continued presence in the US
to
our records show that last year India had an outbreak of Malaria and unfortunately you mentioned that you were in India then...
right you shouldnt have travelled in the past 12 mths - otherwise its fine. i've done it a couple of times

Please feel free to comment or correct any facts.
Fact Sheet: Who's Looking Out for You?
Green Card Visa Numbers Situation
The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
Employment Based Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
USCIS is a self-funded organization i.e. it is run on fees it receives and is short on resources.
What do these jargons mean?
Priority dates will remain retrogressed for several years.
Those who could not file their I-485 now will now have to waitttttt..
Due to resource constraints, security checks may take years.
Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
Endless cycle of EAD renewals and Advance paroles.
For any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.

Another key Republican calls for H-1B cap hike - Computerworld (http://www.computerworld.com/s/article/9215970/Another_key_Republican_calls_for_H_1B_cap_hike)
I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.
Lawmakers will listen to folks who participate in lobby/advocacy activities..apparently H-1B lobby/advocacy is louder than the GC backlog lobby/advocacy and that's what we hear in the news.

Thanks to members who are offering miles to buy air tickets for others, and for coming forward with donations to cover costs of travel and hotel. And to our DC/VA/MD members for hosting out of town members.
However, we still need more such offers, so please come forward on this thread.

Relax buddy.
As long as you sent it by certified mail and have the return receipt, if it does not make into your file and if later they issue an RFE, you have covered your base. As long as your new job satisfied the AC21 parameters and you have the certified mail receipt, you are fine. Relax and enjoy new job.
Hmm, we did not send it by certified mail, my Attorney sent it by DHL. Does that matter?

Guys,
First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.
There are a few things we should strive for:
1. Keep all provisions of Specter's bill related to EB.
2. Re-instate per country soft limit.
If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.

another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.
Yes true. This is the only angle that is viable in theory. All that can be done is challenge that the per country quota violates the constitution. Then the judge can strike that clause off.
Besides this it needs a law change.

Efiled @ TSC on may 29th.
FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.

Here is a different translation
Justaju jiski thi, usko to na paya humne..
I did not get whom I craved for.
Is bahane magar dekh li duniya humne.
In pursuit of my craving, I experienced true world and life.
Roughly it translates to;
Justaju jiski thi, usko to na paya humne..
The person/object whom I was desiring to get it, not achieved it,
Is bahane magar dekh li duniya humne.
Due to this desire, atleast I have seen the world in its true colors

You are right -- 3 Year Bachelor + 3 year Master (in related field) is good to go. 3 Year Bachelor + 2 year Master is unlikely to sail through.
In this case, OP need to establish that his/her Masters is 3 years.
Looks like a few people at USCIS know that some kind of masters degree from india with a 3 years bachelors unrelated to ones profession cannot be used in place of US masters. Did not realize that USCIS has some people who know the rules and play by them. If all USCIS people who approve these cases know about this and if lawyers stop justifying that correspondence masters degree is equivalent of US masters, bogus initial eb2 applications as well as porting could be stopped.
Looks like policiticans are doing some work here.
