Nothing ever is super-fast. Certainly not the green card. You had your share of waiting. Its just that you suddenly see light at the end of tunnel and before you realize you are out of it. So it feels like a dream.
There have been folks who have got their greens in two years flat. Not because they were the smartest workers around. That is lightening fast.

This Pakistani guy came to the US in 2004 fresh off boat to do Masters. Completed Masters by mid 2005, immediately landed job at MS, they started his GC immediately in EB2 ROW and by end of 2005 he had GC in hand. It was ridiculous.
There have been folks who have got their greens in two years flat. Not because they were the smartest workers around. That is lightening fast.

I believe you have to file an amendment to let USCIS know that you intend to continue on H1B after you return using AP OR file for an H1B extension if you are within that timeframe before a transfer.
AFAIK, when you return on AP, you are paroled into the US and the I-94 you get is valid only for the term of your AP. When you send that I94 copy across to USCIS for your H1B transfer, you may have an issue.
I believe this is just procedural since I have seen a lot of people continue working on their H1B for their current employer (Same as GC) after using AP and they have not had any issues.

I hope you are not joking here, did you try to port your EB-3 date to some old PD or change from EB-3 to EB-2?
I am surprised how come PD is not current and USCIS denies I-131 based on the grounds that I-485 approved.
Something is definitely wrong here, unless its USCIS system glitch which considers the preadjudicated (pre-approved) cases as approved and then deby subsequent benefits associated with AoS (I-485) pending application.
Very interesting news for the IV community. Keep us posted on the new developments.

Ok, lets not confuse this case with Ability to pay and get worried about that stuff. I spoke to another person who contacted me and is having the same issue. His 140 was revoked 2 years back and at that time he got a NOID and responded in a timely manner and he was fine. Now he has a denial on 485 stating that his 140 was revoked 2 years back.
This person is neither desi nor did he worked for desi consulting company or had ability to pay issues and has applied for MTR and waiting.
All that float on internet is "indivisdual prespectives" and "interpretations". So do not think too much about it.
AC21 guidelines are clear - you can refer to them on DHS website, Ombudsman's page, USCIS website etc....
From what I have been seeing and as I did a lot of research and continue to do, 140 revocation and 485 denial does have a pattern and this seems to be a procedural or a serious training issue.
Thats why IV core suggests that we have to collectively gettogether and fix this issue and any other issue.

Labor subst is not the real problem; atleast it looks like a small problem now compared to the other one - people jumping from EB3 to EB2 with PD intact. I don't know if this is possible. But if possible, expect HUGE retrogression for EB2 india. I suspect it'll go back to sometime in 2001 - and stay there forever. Indians with PD 2003 or later, even EB2, can kiss their greencard dreams goodbye.

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

You are hitting the right buttons here! You can say it is either laziness or fright/jitters or the comfort of current H1B approval/stamp that is making the large populace to sit tight.
Guess what, once some of the battles are won (we can never win all - they will always be ongoing), we should either knight pappu or induct him to "IV Hall of Fame".
Thank you Janilsal. People like me come and go after finishing their work. I just want IV to be remembered for getting rid of retrogression and solving the GC problems that plague hundreds of thousands of high skilled immigrants. each and every member of IV is important in order to achive this. one member or even the entire core cannot do it alone if there is no support and efforts from IV members. IV members are more important than one member in this struggle.
