For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.I urge you to ask for second opinion. From my understanding it depends how long your I-140 was pending.

I say try to get as many shots as possible at your PCP. For TB and HIV tell him that you have been to India lately and want to make sure everything is okay. For other shots tell him that you are considering to apply for a medical/dental school and need to get vaccination records, which you don't have because everything was done in India. Take all those proof to immegration doctor, he will accept those records.

you cannot say like that. One of my friend got RFE for i-140 ,but 3 others were approved who applied along with him from the same company . RFE is regarding the company details.. Since my I-140 got approved recently, my employer might not have lot of issues with IRS or INS. ??????????? what do you guys think.

Great thread! By the way, you can't join the illegal queue anymore since you had to be illegal by the beginning of this year, and longer you have been illegal the better! Haha! So with your less than 1 year illegal status, you'd probably be still left at the end of the queue along with the legals. And if you've only been without status for a few days, you're probably screwed the worst!
This law is a testament to how poorly the Congress understands what they are doing. Instead of fixing the broken law, which needs to be cleaned up, simplified GREATLY, streamlined and made consistent with both itself and other laws, they're just adding more of the same on the top. This will make the law even more complex and even more people will fall in between the cracks in the future.
This proposal needs to be trashed completely, forget the small measures of raising the caps, etc... You're only putting a bandaid on a gun shot wound. They seriously need to go back to the drawing board and REFORM the ORIGINAL law.

I really appriciate the work of the core members.
i actively particiapted in the tech workers yahoo group, irrespective of hard work by many it failed to make a huge impact, probably because of lack of clear leadership & focus but in the case of IV, the core team's active role and leadership makes our voice being heard in the media and in the US congress.

These are just guidelines from a law firm. Most of the law firms were making money in porting cases for last two years, as number of new applicants were less due to economy. That does not mean that USCIS is going to approve these cases based on number of years of education. Porting within a company is a risky deal. Even though lawers dont make it sound like a big deal, for getting new clients. The old eb3 job that was used to file the first labor needs to be filled. If you are working with a desi bodyshop, be careful. You are inviting an audit.

The fact that IV is helping Donors is because all its activities are only possible because of Donors, and we are still short of funding. If this was for all for free, then no campaign could be acheived.
And believe it or not , we get a lot of spam and rogue users visiting IV.

I would like to know anyone get approve either 140 or 485 from Nebraska service center to get an idea the time frame on my case.

As all the I-140's from CA and VT were transferred to NSC in April so it is slow. I guess they are currently working on cases filed in the month of April. If your I-140 is not approved by December then you might want to consider converting it into Premium Processing so that you can avail the benefits of AC21 once your I-485 is pending for more than 180 days.

I am in the same boat. I have asked my paralegal about it a few times and he seems reluctant. He said they don't normally do it. By law, are they not required to let us have the receipt? Like you, I do have the receipt numbers, but not the physical copy of the receipt. Like you, I currently have no intentions of quitting, but I would like to have a copy... just in case.

I received receipt nos. from CSC. Later i received EAD also. Today i received mail from USCIS stating that my case is transferred to Nebraska. :(
