Can any one tell me is it necessary to Get medical done by Dr. only around ur location.
Reason for asking is I live in NJ. And i got an appointemt with DR. Kim in NY as i know him through somebody else.
He is also more reasonable asking around 190/-

If the person gets the visa stamped on the passport at the US consulate abroad, I do not see any problems re-entering.
AP is only optional. You can always get a valid US visa stamp based on the approved petition and use the H-1 visa stamp to re-enter.

There could be a problem at Point of Entry if the officer notices the exit date before the approval of AP. I think for you to be able to use AP to enter it should be approved prior to your exit out of the country. You might want to consult an attorney or USCIS on this. If the IO at POE stops them there is nothing you can do. So be very careful on what you want to do here.

Petition does not help if you don't have a visa and one wants to travel, Visa is for entry and I94 is for staying in country
3. according to my attorney CIS will take 45 days for the RD to deliver the I797 notice to you home, so if you applied the last days of July, by the 3rd week of September you will receive the I797 notice.
As note my attorney was president of the AILA last year and her husband work in the CIS, so some how the info is trustable.

I totally agree with the majority opinion here.
That IV is the best organised, dedicated organisation out there looking out for people I can identify with.
Have they done a good job? The question is the other way round. This is an open organisation. The core members are easily accessible. Anyone who is willing to contribute in terms of volunteer work, if not contribution, is more than welcome. What are You willing to do?
This is not a rhetorical question... I'm not what they call the core member.. I'm on the outermost orbit. I just contribute money (once, till now) and log in once in a while. But at least I�m doing something, and it makes me feel a little better that for a change, I�m contributing to a genuine bunch of people who are willing to make personal sacrifices for something that affects me.
That said, is all criticism bad? Here is where it gets a little tricky.
Why is that?? Lots of reasons.. About the dangers (and futility) of having a zero-tolerance for criticism in an open web-based community. Some of it, though, does provide a pointer to the complexity of the issue. For instance, one of IV's goal is to guard against discrimination against legal immigration. Queue jumping, in short. Yet, thousands of us are stuck in BEC's (Dallas and more importantly, Philly), awaiting a "labour" certificate. The whole process is idiotic and obviously there is something seriously fishy there since there has been no significant movement in years.. and everything is handed to a 'private' contractor for data entry and software development, and there is NO communication or transparency. (Yeah, you can blame my innate cynicism, but coming from where I come from, I can smell corruption a mile away - and this thing stinks!). Is it on IV's radar? I believe so, and there have been very clear and positive statements on strategy regarding this issue on IV.com. Also, I understand that the focus should be on maximising our efforts on the immediate issue, which is the legislation - especially given our limited resources.
But I would love to have it moved a little towards the centre of the radar screen rather than languishing on the periphery..

there are few famous talk show hosts in KABC radio (Southern california), atleast 5 of them, who have larger listeners and they have devoted one hour everyday regd immigration issues (until they kill this CIR bill because they dont like amnesty issue), they do usually their programs from morning 8am and 5pm-11pm, so I request IV core team to contact their producers using their 1-800 numbers and explain the other side of story i.e. documented workers and how they suffer and what relief this bill can provide us.

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise
As per the bulletin I read, USCIS has indicated they will reject the application without I-693 period. Hence search across whole of US; if need be. Remember another thing, the appointment with Dr. is always two times; first time they take your blood (for AIDS test); then they will call second time after the blood analysis is done; if everything is fine, they would sign the I-693 and put that in a sealed envolpe.

An interview does not mean approval. This is just part of CIS pre-processing cases when the PD is not current. They will interview the applicant, process it and then throw it into storage.
About 5% of cases are randomly selected for interviews. This does not mean that they are out to approve a 2007 case ahead of a 2001 case.

Guys,
Its quite a gathering out here who have shown some interest or support for the Green card issue for the PhDs. I see numbers increasing slowly. I am networking and try to get more PhDs involved and become aware of the PACE Bill. Friends from many universities are contemplating the line of action to get a change in the language as well as to include the current PhD students/PhD holders in getting benefits from the bill.
I and my friends have drafted a letter and will be sending to our senator (Allen Specter) very soon. It will be great if many more enthusiasts come out and show their support / give their suggestions openly.
So lets keep it rolling.

I was in DC yesterday and today and it's a life changing experience. It was very well co-ordinated. Thanks to all the people who showed up. Three cheers to nixstor, Arun and the local team who had the difficult tasks of getting permits, co-ordinating with local authorities and everything went according to plan..Since I had lobby meetings in the PM had to leave early. They still had pletny of work to do. Their hard work paid off...

Suggestion: Let Corporate America handle H1B quota. They don't need our help. Tying up H1B with GC is only hurting us. We are in IV for GC issues.
Movie is not focused on H1b quota. It would tell common public the real side stories of H1 people as they are focused now as job stealers (is wrong). The odds of that and how they struggle on H1 etc.

Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me . I am planning to leave my current employer and move to a different one. I have got my I-140 approved under EB3 category from the current employer. While moving to the new employer, I want to retain my priority dates. I would like to know what kind of documents are needed in order to do the same. I am presuming that a copy of I-140 approval notice would be needed from current employer that I am sure that my current employer would not give me. So what is my chance in this case? is there any way, I can get it from USCIS? Has anybody got it successfully from other than the employer? Are there any other documents , I need from my current employer. Please suggest.

Is any company filing new PERM applications in this economy? I was told that my current company (a really big one at that) is holding off PERMs indefinitely because we had some layoffs- indefinitely!
My H1 runs out in Oct 2010, and I heard that I have only till end of Nov 2009 (including what I found out is called recapture time) to file.
Now, I found out that my company have do newspaper/online ads for positions to demonstate that they tested the labor market etc etc (all stuff that I heard from the attorney), and I got the impression that she has no idea when they are going to do this and start filing again, and I got something like a best of luck look from her. I am freaked out now.
Any of you out there know if any companies are still filing PERMs? I am on a EB-2 in Software.
Also, if I join a new company, can I file a PERM immediately? Or is it just best of luck to me?

They do not care about greencard on H1B thinking that it will come whenver the company applies until it is too late. They enjoy the first 3 years of H1B enjoying America and dollars and do not bother about IV or advocacy or contributing money to IV. I have seen such people even telling others it is a waste of time and making fun of IV. After 3 years they renew H1B thinking that they still have 3 more years. But once 6 years are about to expire they worry that they will have to leave US of A and the land of opportunities. It is at that time they try to start greencard process and check out IV. These same people then start contributing to IV and take this effort seriously.
You still have time of 1 year and 9 months and that is good enough to get your labor through. Good luck and hope you find help from people here.
