a lot of companies are already getting their patent filing work done by attorneys and paralegals abroad. Wont be too long before your I-485 filing is also prepared from outside the US :)
My question is what will the attorneys and para legals do in the US, if they don't find sufficient cases to sustain their operation? What they studied here is not portable for other countries like software.

Same here, Iam Dec 2005 and still waiting ..........
I have been looking at number and the IV forum and there are very handful number of cases with December 2005 that have been touched.
I think we need to cheer up and be optimistic in addition to creating SR, senator route and infopass. I have a feeling that all the October, Nov and December cases might be in a single lump of files and we will get it in the next week or so.

Thanks for the quick response, much appreciated. I think I have the answer to my question.
Essentially:
1. RD will determine sequence in which AOS are looked at by case officers at USCIS. So July applicants with 2006 PD will geat EAD/AP, etc sooner than October applicants with 2002 PD.
2. In the event of retrogression (say to 2005), only those applications which have a current PD at the time of visa approval will get the green card. So 2002 PD will get GC before 2006 PD.

What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.
I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.
This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.

It is obvious that DOL backlog center is processing cases with utter disregard to FIFO procedures. Some people with priority dates in 2004 or 2005 have obtained their labor certifications, but some people with priority dates in 2001 or 2002 still do not know what is happening to their cases. If we file lawsuit against DOL on their inability to maintain FIFO procedures, what are the chances of success? Their inability to maintain FIFO procedures has brought great misery in lives of the people who stood in line for so many years so patiently.

I beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.
They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07
High number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.
Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

If there is anything targeted for any small group...I am sure other will not accept whatever may be the reason. Everyone desperately wants to get out of this mess. I don�t think freeing up the queue theory will help. That�s the reality.
For the shake of argumennt let me ask you...If I get my GC, it will free up one GC in line. Will you accept that and support this. This is the question in everyone's mind now.

If a certain group is not subjected to the quota - say PhDs (although i do not qualify), it will help my cause as much as others in the wait.

After 5 months they're auditing my PERM application. My attorney just sent me an email. They're not asking for specifics but wants to make sure we advertised the position. Attorney's going to submit a report as to why the applicants weren't hired as well.

Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
