I just called them now. I was lucky enough to talk to the operator. She said I should be getting it in a week. I guess they have a back log. She couldn't tell me anything else. BTW my application was received on Sep 11th. Money order was cashed on Sep 23rd. Still in process not shipped yet. I called 713-626-2148 and pressed 1 then 9 and when it asked for voice mail or operator I pressed 0 for operator. I kept pressing 0 until someone answered.

There are too many assumptions here. How I see this situation is;
EB3 I will not move significantly unless and until oversubscribed EB2s become current. Even then, it cannot be taken as granted because the demand of EB2s can take all the spill over and be current without spilling to EB3. USCIS will eventually make the change once they see that EB3 has significant retrogression and there is a lot of noise made about it.
The solution I see is; we can make a valid presentation showing the effects of this spillover change in the long run and how EB3s will be affected seriously.
If DOS continues with this interpretation of spillover then there is a very small (tiny) window coming up in third quarter of FY 2010 (Apr'2010) where we might see some spillover to EB3. Here is how:
Currently there are total 4050 (EB1) + 74932 (EB2) = 78982. These are mostly pre-adjudicated and waiting for VISA numbers.
Total allocation for new FY is 140K out of which 40K (28.6%) will go to EB3. So EB1 and EB2 will have 100K left but their total demand is only 78982. So these 21K numbers will be left which will be used for new applications recieved under EB2 category.
When PD for EB2-I/C moves forward, there will be more applications coming in because many EB2-I/C people have their labor approved and they are waiting to file their I-485. However, when these new applications comes in, they are NOT processed yet and their background check is not clear yet. So even if visa numbers are available for them, they are not ready to be approved.
So at this time we poor EB3 people can hope some mercy from DOS and we hope that DOS might spill those remaining 21K numbers to EB3 so we don't waste any numbers while USCIS is adjudicating those newly recd applications under EB2.
If this 21K spillover happens then we EB3-I have to hope for another mercy from DOS that they give these 21K spillover numbers strictly based on Priority dates in EB3 and not based on EB3-ROW first and then EB3-C and then EB3-M/P and then EB3-I. We expect DOS to give these spillover based on PD and not based on country of chargeability. If that happens then all these numbers will go to EB3-I and we might see it moving to 2003.
And this is a fair expectation from DOS that they give spillover numbers based on PD because that is what they are doing in EB2-. When EB2-ROW numbers goes to EB2-I and EB2-C they go based on PD and hence EB2-I gets most of the numbers.
My two cents. Please post your comments on my theory.

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
Per my attorney- Date of birth info provided my anyone but the local municipality is insufficient and won't be entertained by the USCIS. Unless you and your attorney are willing to try your luk with the RFE, I'd suggest that you get the birth cert from the local authorities.

The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

Unintentional, might be, but you did ruffle this topic of US Master's vs US Non-Master's with this rather sad comment (warm spit!). I dont want to go much further into this either but talking about something that you obviously dont know (useless subjects 'assembly language programming'), you havent added any valule addition here either. (Just FYI, even during peak recession, ppl with ALP skills were really very few because most of the direct recruits from '6 month NIIT courses' werent upto system level programming).
And btw, if think that a 6 month course in NIIT with a degree in tier 3 university is going to help get a job during times of recession, then i dont know what to tell you.
Yes, i do have an MS degree from the US and i did suffer lay-off during recession - bounce back, i did really quickly while i saw few ppl that only had '6 month courses from NIIT' suffer for long times without a job because all they had to offer was that...their six month experience at NIIT!!

Why do we always equate some educational qualification from some institute to capability? Remember Einstein, Bill Gates, Steve Jobs, Cornegie, Rockefeller.... list goes on.

I can't stop thinking of our efforts in DC. As I have already posted, it was a tremendous experience being a part of such campaign. I came upon this thread of adding more members to IV and from what I read, it was successful largely. IV has increased members from 10,000 to over 40,000 since this thread was started.
I am bringing back this thread again, asking our members to get more involved in their state chapters and to encourage our current membership to be more active in the forums and action items. We, who participated in the DC event, can hold conference calls (if our members are separated widely across the state) or meet in local libraries (if many of our members are in the same city) and talk of our experience in DC and what needs to be done ahead.
Fellow participants, please do come up with suggestions on how to keep the momentum going.........

Folks,
I am a passive IV listener and this is my first post. I was not expecting my GC to be approved for atleast a year since my priority date was Dec 04 and this is the first time I am current. Also, I applied for I-485 only last year in Sept 2008. So it was unlikely they will look at my case since there were people before me from 2007. However as random as they are, I got the e-mail today that they ordered the production card for me. I am EB-2 and my case was st forward though, no RFE's ever and I have not changed job as I am pretty happy where I am. Anyways, all the best to the folks waiting.

It seems like the major disagreement is on the issue of "granting amnesty" or that sort of act to illegal immigrants. Not sure if this is going to make a difference but approaching congress members with the concerns of legal skilled immigrants might make some difference. So if there happens to be a discussion and in which case more than likely the house will focus on the provisions included in the house version of the immigration bill which primarily focuses on border security etc. may still pass. If that happens there is a slight chance that they may agree on some if not all of the provisions for the legal skilled worker. We can do web fax thing or contact over phone etc....doesn't hurt to try......

3) Capture the unused Visa (Green Cards)
Exactly, it is okay to have country cap for those who are coming in through lottery or for those who come in through family based GCs. But for employment based GCs, it should be the skill that matters, not from which country he comes from.

We need about 1000 members signing up for the monthly contributions in a month. I am sure we can do that. We have 8000 members and it should be easy. Till now we have only 100 signups
