my wife filed on may 29th, soft lud on june 6th and fp done on june 21st. no updates/luds after the one on june 6th.
my wife called them last friday and opened a SR.. we'll see if that helps.. i think we will go ahead and schedule infopass as well..

I got the CPO email just now.. i'm not sure if it's because of the SR that my wife opened on Friday evening or it just happened without that.. but anyways it's a relief now.. i also see a lot of people getting cpo emails today.. btw, just curious, does the cpo stage come before "approved" status or after it?
now hope that i receive the card in time.. will post about its validity and start date once i receive it. (i'll be current for the month of September as my pd is july 06)

Do we just need copies of the birth or marriage certificates or do we need to send in notarized or original documents.
I have copy of my birth certificate which I have been reusing. Not sure where the original is.

Oh yes, sick leave, have you worked for Losers and Traiters on site? do they have a sick leave policy for on site slaves? do any one of them have one for sick leave or for that matter anything else? would you send me one from your company?
My friend was working for Losers and Traiters - got real sick due to neck pain - took leave from work - went to a doctor - doctor suggected him a treatment for a month. Guess what, they shipped him back. Who will have an "idle resource" on site? How ethical.
I asked them to provide a copy of their US insurance policy and on-site employee handbook. I am yet to get one, besides the manager told me since I am no way connected to Losers and Traiters (who wants to?), I am not allowed to ask for such documents. The poor slave friend of mine went to India and resigned within a week.

On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

My wife's status changed from H4 TO H1. Recently when she went to apply for her SSN, the officer there took her original approved H1 along with I-94 and never returned it to her. She assumed that they would need the originals . I didn't know about this since I live about 200 mi away from her.
We will contact them on Monday but in the worst case scenario, if they have lost it. Do I need to apply for a new I-94 or a copy will suffice.
Any hope??

Is that rite? 2 wks after the case is assigned to an officer approvals r coming thru? Is that the trend?

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. I am looking for advice on the strategy for filing the third phase since the PDs for my wife and me have become current. My PD is Feb 2003 (EB2) and my wife's is June 2003 (EB3). My wife and I are on 8-th yr H-1B extensions with approved I-140s. Which strategy makes sense and are they even valid? The objective is to go with a risk-free strategy that gets us the GC in the quickest manner.
1. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for I-485 (AOS) using her PD, with me as dependent.
2. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for Consular Processing using her PD, with me as dependent. OR vice versa.

Ok I apply for I-485 and EAD.because the Visa numbers are current for my date..USICS takes my application in November for processing and my Visa number are then regtrogressed...then they will not process my GC right??..untill the number becomes current again...so I will have to wait on my EAD....???.

Hello everyone,
Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :
1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?
2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.
3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.
Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

The message you have to deliver when calling these offices is
I would like Representative "Representative Name" to co sponsor bills HR 5882, HR 5921 & HR 6039 sponsored by Zoe Lofgren. All three bills have wide bipartisan support in the house and will help reduce the back logs associated with USCIS. These bills are a great first step towards immigration reform.
DO NOT GET INTO THE LEGAL/ILLEGAL DISCUSSION WITH STAFF MEMBERS
